Minimum Heat Requirements of New York State Apartments
If you are one of the many across New York State living in an apartment, you may want to take note of the minimum heat requirements according to state law.
Heating season, which is identified as October 1st through May 31st yearly, requires apartments to carry the following heat requirements:
- DAYTIME: 68 degrees minimum when the outside temperature falls below 55 degrees between 6am and 10pm.
- NIGHTTIME: 62 degrees minimum between 10pm and 6am.

In addition to heat requirements, in New York, landlords are also required to provide hot water at a 'constant temperature' of at least 120 degrees, this is a year round requirement.
Though laws are a bit more defined for those living in New York City, there are still regulations and minimums across the state when it comes to heat and hot water by landlords for renters. According to data reported by NYC.gov Housing Preservation and Development, New York City heat complaints in 2024 for the 'heating season' have climbed over 106,000, up from the 97,000 reported for the previous year's season.
